General terms and conditions of sale

These terms and conditions of sale are entered into on the one hand by Olinea, whose registered office is at Chemin de Malavernaz 7, 1806 St-Légier, Switzerland, registered in the Commercial Register under number CHE-154.191.315, hereinafter referred to as “Olinea”, and which manages the www.olinea.ch website, and on the other hand by any individual or legal entity wishing to make a purchase via the www.olinea.ch website or in any other way, hereinafter referred to as “the buyer”.


Article 1. Purpose

The purpose of these conditions of sale is to define the contractual relationship between Olinea and the buyer and the conditions applicable to all purchases made via the www.olinea.ch website. The acquisition of a product through this site implies unreserved acceptance by the purchaser of these conditions of sale, which the purchaser acknowledges having read prior to ordering.

Olinea reserves the right to modify its conditions of sale at any time in order to comply with any new regulations or in order to improve the use of its site. As a result, the applicable conditions will be those in force on the date of the order by the buyer.

These conditions may also apply to a contractual relationship that is not linked to the website.


Article 2. Products

The products offered are those shown on the company’s website www.olinea.ch within the limits of available stocks. Olinea reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible but are not binding on Olinea. The sale of the products presented on the www.olinea.ch website is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.


Article 3. Prices

The prices shown on the internet catalogue pages are in Swiss francs (CHF) and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Olinea reserves the right to modify its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order will be the only price applicable to the purchaser. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In Switzerland, for all orders of CHF 130 or more, delivery costs are free; for all orders of less than CHF 130, a flat-rate contribution to delivery costs of CHF 10 including VAT will be invoiced to the purchaser.

Article 4. Methods of payment

Olinea offers the buyer the option of ordering and paying for its products in several stages, with a choice of 2 payment options:

  • Payment by bank transfer: the buyer selects the products he/she wishes to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The delivery costs are then calculated and submitted to the buyer. The buyer then chooses the payment method of their choice: “Payment by bank transfer”. At the last stage, the buyer is asked to check all the information, to read and accept these general terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the “Confirm my order” button. This final click constitutes the definitive conclusion of the contract. As soon as the order has been validated, the buyer receives an order form confirming that the order has been registered. In order to finalise payment and process the order, the purchaser must contact their bank in order to transfer the amount of their order to Olinea’s bank account, the details of which have been communicated to the purchaser. As soon as the transfer is received, the order will be processed and the buyer will be informed by e-mail. Olinea will dispatch the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.
  • Secure payment by Paypal or credit card: the buyer selects the products they wish to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: “Payment by Paypal”. The next step is to check all the information, read and accept these general terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the PAYPAL secure interface to enter their Paypal account details or personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by Paypal account or credit card is irrevocable.
  • In the event of fraudulent use of the card, the purchaser may demand that the card payment be cancelled, and the sums paid will then be credited back or refunded. The holder of a bank card is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder’s written objection. The Cardholder shall not be liable for any costs incurred in returning the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase. All of the data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, Olinea will send an e-mail confirming that the order has been registered.

Article 5. Retention of title

The company Olinea retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.


Article 6. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are placed either by Olinea directly, or by La Poste or a similar delivery service with tracking, delivery and signature. Delivery times are given as an indication only; if they exceed sixty days from the date of the order, the sales contract may be cancelled and the purchaser reimbursed. Olinea may provide the purchaser with a tracking number by e-mail. The buyer is delivered to his home by his postman. If the purchaser is absent, he/she will receive a delivery notice from the postman, which will allow him/her to collect the products ordered from the nearest post office, within a period indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of Olinea. The purchaser is obliged to check, in the presence of the employee of La Poste or the delivery person, the condition of the packaging of the goods and its contents on delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.


Article 7. Warranty

In the absence of provisions to the contrary, the rules of the Swiss Code of Obligations on warranties shall apply, in particular the specific rules on warranties for defects in goods. In the event of proven non-conformity of a product sold, it may be returned to Olinea, which will take it back, exchange it or reimburse it. All claims, requests for exchange or reimbursement must be made by post to the following address: Olinea, Chemin de Malavernaz 7, 1806 St-Légier, Switzerland, within 5 days of delivery.


Article 8. Responsibility

In the distance selling process, Olinea is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.


Article 9. Intellectual property rights

All elements of the www.olinea.ch website are and remain the exclusive intellectual property of Olinea. No-one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, any elements of the site, whether in the form of photos, logos, visuals or text.


Article 10. Data of a personal nature

The company Olinea undertakes to preserve the confidentiality of information provided by the purchaser, which he/she may be required to transmit in order to use certain services. In this respect, Internet users have the right to access, modify and delete information concerning them. They may request this at any time by post to the following address: Olinea, Chemin de Malavernaz 7, 1806 St-Légier, Switzerland.


Article 11. Settlement of disputes

The parties shall endeavour to settle any disputes between them amicably.

The sole place of jurisdiction is the registered office of Olinea. In addition, Olinea is authorised to take legal action against a customer at its domicile, at its registered office or before any other ordinary court.

The legal relationship is subject solely to Swiss substantive law to the exclusion of the provisions of private international law.
